PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

1. About Us

These Terms apply to all sales of goods by West Building Supplies Ltd (“we”, “us”, “our”).
Registered in England & Wales (No. 4339991).
Registered office: Medina House, No 2 Station Avenue, Bridlington, East Yorkshire, YO16 4LZ.

2. Application of These Terms

2.1 These Terms apply to all orders placed via our website, in-store, or by phone/email unless separate trade account terms have been agreed.

2.2 If you hold a credit/trade account, separate Trade Terms & Conditions will apply and take precedence over these Terms where applicable.

2.3 By placing an order, you confirm that you accept these Terms.

3. Orders & Contract Formation

3.1 You may place an order by following the checkout process on our website or via our trade counter.

3.2 You will have the opportunity to review and correct errors before submitting your order.

3.3 A contract is formed only when we accept your order, which may occur when:

  • we dispatch the goods, or
  • we confirm your order in writing, or
  • we make goods available for collection

3.4 We reserve the right to refuse or cancel any order at our discretion.

4. Product Information

4.1 All images, descriptions, and specifications are for illustration purposes only.

4.2 We make reasonable efforts to ensure accuracy but do not guarantee that product descriptions, images, or pricing are error-free.

4.3 We reserve the right to correct errors and cancel or amend orders where necessary.

5. Price & Payment

5.1 Prices are as displayed at the time of order and may include or exclude VAT as stated.

5.2 Delivery and other charges will be shown at checkout where applicable.

5.3 We accept payment by major debit/credit cards and other methods displayed on our website.

5.4 All payments are subject to validation checks and authorisation by the card issuer.

5.5 If payment is refused, we will not process the order.

5.6 For trade customers, we reserve the right to:

  • require payment in advance, or
  • apply agreed credit terms

5.6 Allocation of Payments: Unless otherwise agreed in writing, we reserve the right to allocate any payments received from you to any outstanding invoices at our discretion, including applying payments to the oldest outstanding invoices first.

6. Delivery

6.1 We aim to deliver within the timeframe stated at checkout, but delivery dates are estimates only.

6.2 Delivery is to ground floor access only unless otherwise agreed.

6.3 You are responsible for ensuring:

  • safe access for delivery vehicles
  • adequate space and conditions for unloading

6.4 If delivery cannot be completed due to access issues or incorrect information:

  • goods may be returned
  • additional delivery charges may apply

6.5 Risk in the goods passes to you upon delivery.

7. Collection (Call & Collect)

7.1 Orders may be collected from our trade counters during opening hours.

7.2 You will be notified when your order is ready for collection.

7.3 Orders not collected within 21 days may be cancelled and refunded.

8. Availability

8.1 All goods are subject to availability.

8.2 If items are out of stock:

  • we may offer alternatives,
  • place items on back order, or
  • cancel and refund the unavailable portion

9. Cancellation & Returns (Consumers)

9.1 If you are a consumer, you have the right to cancel your order within 30 days of delivery or collection.

9.2 You must return goods within 14 days of cancellation.

9.3 Goods must be:

  • unused
  • in original packaging
  • complete with all components

9.4 We will issue a refund within 14 days of receiving the returned goods or proof of return.

9.5 We may deduct for any loss in value due to handling beyond what is necessary.

10. Exclusions from Returns

Returns are not accepted for:

  • bespoke or made-to-order goods
  • personalised or cut items
  • goods opened where hygiene or safety applies
  • items damaged due to misuse

11. Faulty or Incorrect Goods

11.1 You must notify us of:

  • damage or shortages within 48 hours of delivery

11.2 If goods are faulty:

  • you may be entitled to repair, replacement, or refund

11.3 Manufacturer warranties (where applicable) are handled directly with the manufacturer.

12. Liability

12.1 Nothing in these Terms excludes liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any liability that cannot be excluded by law

12.2 Subject to the above, we are not liable for:

  • indirect or consequential losses
  • loss of profit, revenue, or business

12.3 Our total liability is limited to the price paid for the goods.

13. Retention of Title

13.1 Goods remain our property until paid for in full.

13.2 Until ownership passes, you must:

  • store goods safely
  • not damage or dispose of them

14. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including:

  • supply chain disruption
  • extreme weather
  • industrial disputes
  • pandemics or government restrictions

15. Health & Safety

15.1 Some products may be hazardous if used incorrectly.

15.2 You are responsible for ensuring goods are used safely and in accordance with instructions.

16. Data Protection

We process personal data in accordance with UK data protection laws.

17. General

17.1 If any provision is found invalid, the remainder shall remain in force.

17.2 These Terms are governed by English law.

17.3 Any disputes shall be subject to the jurisdiction of the English courts.
